A Kentucky man accused of forcing an elderly woman to perform a sex act on him in a department store dressing room has been indicted for rape and sexual battery by a Sumner County grand jury.
Michael E. Foster, 45 of Murray, Ky., was indicted earlier this month for an alleged incident that occurred in October at Kohl’s in Hendersonville.
A Gallatin woman reported to Hendersonville police on Dec. 1 that she was approached about a month earlier by a man who identified himself as a security officer at Kohl’s, according to a police affidavit filed in Sumner County General Sessions Court.
The man produced an ID card and accused the woman of stealing items, according to the affidavit. He then led her to one of the dressing rooms where he fondled and kissed her breasts, forced her to perform a sex act on him and attempted to take her pants off. The woman said she was able to kick the man away and left the store.
After obtaining and viewing the store’s surveillance video, police determined that the alleged incident occurred on Oct. 27, according to the report written by HPD Det. Jacob Sprouls. Police were also able to corroborate much of what the victim told police happened outside of the dressing room, Sprouls wrote.
Through the investigation, Foster was identified as a suspect after police learned that he worked for a company that contracted with Kohl’s to clean their facilities. Foster was later identified in a photo lineup by the alleged victim, according to the affidavit.
The affidavit also states that police also learned of other incidences involving Foster including on Nov. 5 when a customer at Kohl’s in Hermitage caught the man peeping under her daughter’s dressing room stall. On Nov. 23, a customer at the Kohl’s store in Hendersonville complained to the manager that Foster followed her into the dressing room.
Two days later, Foster was found to be taking pictures of customers in the dressing room at the Kohl’s store in Spring Hill, Tenn., according to the affidavit. He was arrested for this offense on Nov. 26, the report states.
According to news reports in Murray, Ky., Foster was arrested by Kentucky State Police on Dec. 8 after a warrant was issued in Tennessee charging him with rape. He is currently being held in the Sumner County Jail on a $100,000 bond. Foster was formally indicted last week on the charges of rape and sexual battery. His is scheduled to be arraigned in Sumner County Criminal Court on March 23.
When contacted by email, a spokesperson at Kohl’s corporate office in Menomonee Falls, Wis., said that the company is “cooperating with authorities leading the investigation,” and declined further comment.
